communication work schedule
PixieGirl Designs is available by e-mail 24 hours a day and by phone from 9:00am-6:00pm EST. E-mail communication is preferred whenever possible, which helps facilitate the documentation of design/project discussions. All artwork revisions should be submitted by email to ensure accuracy. Of course, this may not always be appropriate and phone conversations may be scheduled as they are needed.
The client must establish ONE point of contact. The point of contact (”POC”) is the one person from your company that will work and communicate directly with the PixieGirl Designs through project completion. This is very important. Having more than one POC can lead to confusion and extra development time.
PixieGirl Designs is an “after-hours” design agency. All revisions will be made after regular business hours and will be available for review in the mornings.
billing and payment
PixieGirl Designs sends PDF Estimates and Invoices by e-mail. Printed Estimates and Invoices can be submitted upon request. If you require printed invoices sent by mail, please inform me upon project commencement in order to avoid any delays.
A deposit of half the total fees will be required, no work will commence until first payment is received. Final payment must be presented immediately upon completion of work (and no later than 14 days from invoice date). If an alternate payment schedule is required/preferred by the client, arrangements must be made before work commences.
On larger projects, one-third of the total invoice is due upon commencement of the project. A second one-third payment will be invoiced at design template completion (or other mutually agreed-upon phase of the project). The remaining balance will be invoiced upon project completion.
If you request additional work beyond the scope of the original proposal, your overall cost will increase, and the development time will be adjusted as needed.
PayPal® payments are accepted. Please note that a 3% fee will be incurred to cover PayPal fees.
ownership of artwork
Until full payment has been received, Yaritsa Arenas (PixieGirl Designs) retains full ownership of all original artwork or parts contained therein, whether preliminary or final. No idea, preliminary design or variant, should be used by the client until final payment has been made.
Upon full payment, the client shall obtain ownership of the final artwork to use and distribute as they see fit. Yaritsa Arenas retains the right to use the completed project and any preliminary designs for the purposes of design competitions, future publications or designs, educational purposes, marketing material and portfolio. Where applicable the client will be given any necessary credit for usage of the project elements. For websites, PixieGirl Designs requires a design credit, linking back to the PGD site, located in either the footer or contact section.
third party shipping / production schedule
In the event any material necessary for the production of the project must be shipped to a third party for additional processing, typesetting, photographic work, color separation, press work or binding, PixieGirl Designs will incur no liability for losses incurred in transit, or due to the delay of the shipper of the third party.
Claims for defects, damages and/or shortages must be made by the client in writing within a period of seven (7) days after delivery of all or any part of the order. Failure to make such claims within the stated period shall constitute irrevocable acceptance and an admission that they fully comply with terms, conditions and specifications.
The client will assume any shipping or insurance costs related to the project. Any alteration or deviation from original specifications involving extra costs will be executed only upon approval from the client. The designer shall not incur any liability or penalty for delays in the completion of the project due to actions or negligence of the client, unusual transportation delays, unforeseen illness, or external forces beyond the control of the designer. If such event(s) occur, the designer shall be entitled to extend the completion/delivery date, by the time equivalent to the period of such delay. Extensive delays in schedule by part of the client and/or radical changes to original brief may incur additional costs.
printing of final project
The designer willl make every effort to ensure the final product is free of any grammatical and/or spelling errors before giving the final product to the client. However, it is agreed that it is the client’s responsibility to ensure that there are no spelling or grammatical errors contained in the final product. It is agreed that the designer is not responsible or held liable for any errors contained in the final product after the final product has been committed to print or posted in view of the public.
rejection / cancellation of project
The client shall not unreasonably withhold acceptance of, or payment for the project. If, prior to completion of the project, the client observes any non-conformance with the design plan, the designer must be promptly notified, allowing for necessary corrections.
If the project is to be postponed, the designer must be informed as soon as possible so a new schedule can be arranged. After a period of one (1) month of non-activity, a project will be considered cancelled unless alternate arrangements have been made.
In the event of cancellation of the project, due to non-activity or otherwise, ownership of all copyrights, original artwork and disks shall be returned to and retained by Yaritsa Arenas.
A fee for work completed, based on the estimate price and expenses already incurred, must be paid by the client.
Any controversy or claim arising out of or in connection with the Project Agreement, its enforcement or interpretation, will be resolved in New York City, under any applicable NYC laws.
confidentiality
All correspondence and documents provided will be treated as confidential between the client and the designer, unless consent has been granted by both parties involved.
